The order was adopted regarding the approval of the methodological norms regarding some
measures to regulate the sale-purchase of agricultural lands located extra-murros, respectively
the modification of the law regarding the privatization of companies holding public and private
state lands under agricultural destination and the establishment of the State Domains Agency .
The methodological norms apply to the transfer of the property right based on a sale agreement
authenticated by the notary public, as well as based on a court decision that takes the place of the
sale agreement and applies to both the entire land and the share of the land.
In case of alienation of land, the seller submits to the mayor’s office the request for posting the
sale offer, followed by a series of documents, and the mayor’s office sends to the central
structure, respectively to the territorial structures, the file containing all documents, within 5
working days from the registration date.
Regarding the list of preemptors communicated by the mayors, it can be completed after the
transmission to the central structure, or to the territorial structures with the preemptors who
prove this quality and submit to the mayors notices of acceptance of the seller’s offer within 45
working days from posting the offer for sale, under penalty of forfeiture.
