A law has been adopted establishing some measures for the implementation of the provisions of
Regulation (EU) 2017 / 1.939 on the application of the form of enhanced cooperation regarding
the establishment of the European Public Prosecutor’s Office (EPPO).
Thus, whenever in a normative act reference is made to the prosecutor or to the criminal
investigation entity, the reference is also considered to be made to the European delegated
prosecutor.
The competent national authorities shall notify the European Public Prosecutor’s Office in
situations where, upon notification or ex officio, they find elements regarding a crime for which
the European Public Prosecutor’s Office could exercise its competence according to the EPPO
Regulation.
The activity carried out by the European Public Prosecutor’s Office in Romania is supported by
all competent national authorities according to the EPPO Regulation, especially by the criminal
investigation entities of the judicial police within the Ministry of Internal Affairs, the Department
for Anti-Fraud, the National Fiscal Administration Agency, management of European funds and
other institutions with attributions in the protection of the financial interests of the European
Union in Romania, the Ministry of Justice and the Ministry of Funds.
Therefore, within the National Anticorruption Directorate, the Support Structure of the European
prosecutors delegated in Romania is established, which operates with a maximum number of 20
positions, out of which 5 positions of judicial police officers and agents, 8 positions of
specialists, 5 positions of auxiliary staff (clerks) and two related staff positions.
