Ordinance establishing the legal and institutional framework necessary for authorization and operation in Romania of branches foreign companies and economic organizations authorized by Ministry of Entrepreneurship and Tourism has been adopted.
Application for opening a branch office and issuance the authorization for operation of a branch office shall be filled in electronically through dedicated electronic platform and addressed to Ministry of Entrepreneurship and Tourism, which issues, in this regard the authorization for operation.
Operating authorisations of branches foreign companies and economic organisations are issued, at their request, by Ministry of Entrepreneurship and Tourism, through an electronic platform, for a minimum period of 1 year, with the possibility of extension for the same period.
To obtain the operating license, an authorization fee of 1,000 euro/year, equivalent in lei, at exchange rate of National Bank of Romania on date of payment, is charged.
For the activity carried out in Romania, branches are obliged to register for tax purposes in Romania and to pay taxes in accordance with the provisions of Fiscal Code. Issued operating authorizations are withdrawn ex officio, within 30 days of their expiry, by Ministry of Entrepreneurship and Tourism, when validity of operating authorizations expires and no request for extension has been communicated.
