Essential provisions have been adopted by the president of the National Agency for Public
Procurement regarding the performance of a agreement or a framework agreement in case there
is a need to amend it, for which the contracting authority will determine if this would be a non-
substantial change of the agreement without the need to organize a new procedure or a
substantial change that would require the organization of a new award procedure.
For each contractual change, the contracting authority performs an analysis on the need and
justification of the change, which is formalized by a document, accompanied by detailed
supporting analysis at which the classification is demonstrated and submitted for approval by the
legal representative of the authority or by persons empowered by it.
Moreover, during the entire duration of the implementation of the agreement / framework
agreement, a register of modifications will be maintained, which will indicate for each
modification the data regarding the description of the modification, the purpose of the
modification, its value and the new value of the agreement / framework agreement.
