The decision was adopted regarding the establishment of the guarantee-return system for
unusable primary packaging which has as object the management of packaging and
packaging waste.
The guarantee-return system forces into operation starting with October 1, 2022 and is
mandatory for all producers and traders, applying both to products manufactured on the
national territory, and to products imported or purchased intra-community.
Manufacturers that introduce packaged products on the national market have the obligation to
register in the guarantee-return system, having the obligation to send a notification in digital
format with a qualified electronic signature.
At the same time, traders have the obligation to register in the database managed by the
administrator of the guarantee-return system within 90 days from the date of publication on
the website of the central public authority for environmental protection of the announcement
on the appointment of the guarantee system administrator-return, which have the same
obligation as the producers, namely to send a notification in digital format with electronic
signature.
Consumers or end users can return the packaging of the guarantee-return system within any
return point organized by traders in Romania, regardless of where the packaged product was
purchased and without being able to be conditioned by the presentation of the tax receipt in
order to recover the guarantee.
